If a cultavar is patented is really is illegal to take cuttings to start your own or even to get additional plants by taking cuttings from your own plants. The thing is it is so hard to enforce/protect the patent that they very seldom even try to do it below wholesale level. As an example the patent holder might go after the vendor that wholesales to walmart and leave walmart and their customers alone. Now If they can prove that Walmart knew that the plants were 'knockoffs' then they might go after Walmart due to the damages that they know walmark can well aford.

I have bred up tomato and cosmos varieties the old fashioned way and have given the seeds away. I'll even tell you what the crosses were. Use Marianna's Peace as the female, hopefully one selected for several generations as healthiest plant each year, with Giant Syrian as the male, hopefully selected as the biggest for several generations. Your F1's will be very strong plants that can perennialize indoors through winters 4 at least 4 years. They will be Regular leaf, and the tomatoes will be sweet and strong. The F2's will all be good! One 4th will be Potato Leaved. They will all be healthy and very productive. Cosmos: I rub the male flower picked onto the female flower face lightly and get about 50% crossed seed. Maybe more like 60%. I repeat that 2 or 3 times a day for 2 or 3 days on the same female flower. Seashell crosses real well with Picotee. The F1 looks like a Seashell not quite perfect. Most of the F2's do too, but maybe half show the picotee coloring. Look for the few perfect Seashell flower form with the Picotee coloring, and cross those together. The next generation from those are mostly perfect Seashells, and most are Picotee. Cross the perfect ones together again. Those should all be perfect Seashell Picotees!

Argh... I plunder & appropiate, I may be a pirate, but I sure won't spend gas money to drive to a store, to pay for something someone else considers trash, or a weed. Hence my skull pic! I looted that too!
As for my secret gardens, my neighbor does not "farm" his hedgerows, so I do. Plundering.

I know. Its kinda wild. When blackberries take over an area, its hard to kill it cuz its starts to reproduce on its own. I think if I keep on top of things, I might actually be able to harvest enough wild berries before all the locals remember to head to the woods. DH wants to make a few gallons of wine and I'd like to juice some for dumplings throughout the year. But I'll also have a small harvest right in my yard that is all mine (yeehaa).

When I was a kid it was not unusual for people to have "secret spots" in the woods for berries, mushrooms, nuts and asparagus. Shoot, I even got wild leeks and all kinds of other goodies I don't think anyone knew of! So sad to see most of these places wind up going to housing, malls and roads. :(

Know what you mean. We used to have lots of wooded areas and sugar cane plots, but now many, many neighborhoods and maybe only half of the people are Cajuns........natural born locals. DH used to have another resource he and his dad and brothers would tap into....the rabbits. They kept beagles and would go hunting together. Can't do that very many places anymore. Its not even worth it for him to get a hunting license.
