Okay, from what I have gathered....the employER is to match the employEES SS, Mediwhat the flip and pay in to their unemployment. DH is DEFINATELY defined per IRS definition as an employEE not and independent whatchamajiggerdoomaflop...so thus the brain scramble. IF DH gets "laid off" or whatever...there will be no unemployment compensation to draw from in this case...which could be devastating considering the industry he is in....so I'm kinda eh...irritated a smidgen about that. I've been almost to the point of losing my home, and I aint going back to that place without a fight. I'm ready to kick some tail if we don't stop getting jerked around, and I think that may be happening :rant

Otherwise I'm not any help on this one.

I know that when I was a independent contractor (medical transcription), we just had much, much more withheld from my husband's check (IRS suggested this) and you can call them with questions (they answered ours).
Thing is...we can't afford to pay it in. He'd have been better off unemployed :barnie :/ Disgusted here....

Let me get this straight. The employer should be paying his part of SS, Medicare, and into Unemployment Comp. He's not doing this, expecting you to? Or is he just not automatically deducting your portion of those?

DH gets a gross paycheck. Employer is paying NADA, nothin, zip. No medicare, no Soc. Sec., no unemp. comp. I don't know HOW to do that, and making 12 an hour...we cant afford it either. Emplyoers are supposed to pay half of the SS/Medi and pay into unemployment comp. but that is supposed to be BEYOND gross pay ammounts...totally the responsibility of the employer. so I haven't a frickin clue what to do.

This^^^^ is what I have found along with the definitions of employee/contractor etc. We can pay our half of those things withheld in a usual manner, but he will not be eligible for unemployment comp should they run out of work, temp layoff, etc. etc.

Thus the glitch...if we file like that then they will automatically go after the employer...and DH may still lose his job. No win.

If you don't, you could be in more bigger trouble -you could lose everything. You gots to do the right thing. ;) Moral victories still stink.
