I'm gonna scoot. after 11 here and long day tomorrow over at the National Cemetery. They want color guards from every YM unit there and enough YM so that all of the State flags and service flags can be held by a YM during the services. We'll be there something like 6 hours. Son had to polish his boots three times tonight to get all the mud off of them from the last event. Uniform still needs to be pressed in the morning.

If anyone wants, I'll post photos if I can get some good ones.

I bought a lemon a couple years ago from this shady car salesman...maybe i should go find THAT lemon and chck it at his head, then I might be satisfied with the results.

Wow, pics YES!!! you two guys have a great time!!! I'm goin to bed too. Didn't I say that like 30 minutes ago?!

If he meets the definition of employee, the employer MUST by law abide by the code. If he doesn't, then the contractor MUST by law pay his own stuff BUT that is covered by EXTRA charge by the contractor. Generally a contractor makes 1.5 to 2 times the amount of an employee, just to cover the extra nonsense they have to go through (extra filing, payments, self-employment taxes, etc.)

Your DH needs to go in and tell the guy - "either you pay me what you owe me or you deal with the IRS. " Most people are scared s*#@less of the IRS and will comply just to avoid problems.

I have no idea what kind of work your husband does but it sounds like he's being paid under the table. Yes this is illeagal on his bosses part. Most people who're paid this way just take their check to the bosses bank and cash it. The money never hits your bank account and noone knows nuttin'. Including the IRS. The downside to this arrangement of course is there are no unemployment taxes being paid by the boss. But what's worse are usually no workers comp is being paid either. Your husband gets hurt, his bosses attitude will be that's your problem. Plus these people have a much higher chance of running off with the last checks and not paying people completely. No paperwork; no proof.
But let's pretend that your hubby is an ind. contractor.
You can have more taken out of your check to cover his taxes. Or bussinesses pay taxes quarterly. You figure that you will owe say $1k. You pay the IRS $250 every quarter with a 1040 es (?) form. For yearly taxes you'll use a 1040. For him you start with a scedule C to take deductions off his gross pay. Then you move on to a sced. SE. This is the one you pay your SS taxes. But your paying the full 15.9%. What you pay and your boss pays. They're not as complicated as they seem. That's for a simple sole proprieter. This is still not taking into account the workers comp issue though. Someone has to be paying that. If you really want unemployment taxes to be paid, you'd incorporate so then your husband would be an employee of himself. Then he would have to pay unemployment and workers comp on himself and then your dealing with some of the scariest tax forms you've ever imagined. Plus you'll only be making $4 ph at that point.
So he has 2 choices now. Keep his mouth shut. Cash checks at the bosses bank and never deposit the money into yours. And continue looking for a real job.
or
Look harder for a real job and keep track of the money. Then when he finds one, report the guy. The workers comp bureau is way scarier to these people than the IRS will ever be. You can't imagine the fines they can hit this guy with if he's caught. I actually had a job that paid under the table but the guy still paid workers comp.

I'll add to the confusion.
Both my husband and I work for the same company. Both of us are self employed, too. We're classified as independent contractors. Very legal.

We each get a 1099 at tax time. For all that crap that goes along with that, there's some help there. Your husband can claim all his miles to and from work, any clothes, tools, equipment, meals, motels, etc used for work. I think we could write off $0.50 per mile this past year.

There are so many variables, you really do need to call someone who can explain this to you, based on your own situation. Do you have someone do your taxes? Call them. And start keeping odometer readings and receipts now.

This happened to me once. After I filed my taxes, as an independent contractor (which is what my employer called me), the IRS audited my employer. He ended up in court and I had to testify against him.
